Contest Rules
THE PRIZE
One (1) $2,500 shopping spree to be spent at Carlingwood Shopping Centre within the terms of the gift card agreement time frame - 15 months. Prize will be made up of Carlingwood Gift Cards to be used at the Winners Discretion for purchase of merchandise at participating Carlingwood Merchants and will not be exchanged for cash.
THESE RULES GOVERN THE "WIN A $2,500 WINTER SHOPPING SPREE" CONTEST DESCRIBED BELOW. THEY INDEMNIFY CARLINGWOOD SHOPPING CENTRE AND OTHER PERSONS FROM LIABILITY AND CONTAIN OTHER IMPORTANT PROVISIONS. EACH TIME YOU ENTER, YOU ACKNOWLEDGE AND SIGNIFY THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE RULES AS THEY THEN READ. IF YOU DO NOT AGREE WITH EACH PROVISION OF THESE RULES, YOU MAY NOT PARTICIPATE IN THIS BALLOT DRAW.
CONTEST ENTRY PERIOD: THE "WIN A $2,500 WINTER SHOPPING SPREE" CONTEST offered by Carlingwood Shopping Centre commences January 17, 2008 at 9:30 a.m. (local Ottawa time) to February 29, 2008 at 11:59 p.m. (local Ottawa time).
HOW THE CONTEST WORKS AND HOW TO ENTER
Purchase Carlingwood Gift Cards from Carlingwood Customer Service, for every ten dollars ($10 CDN) worth of Carlingwood Gift Cards purchased one unique PIN numbered card will be given to purchaser for entry at www.carlingwood.com.
No purchase necessary - a free Special Code is available on a Carlingwood direct mail tabloid being delivered to select geographic areas in and around Ottawa, Ontario. If you do not receive a copy you can receive one (1) from Carlingwood Customer Service while supplies last. This code allows you to enter at www.carlingwood.com without making a purchase - the code can be entered one (1) time per calendar day during the contest period per household.
Visit www.carlingwood.com - click on the "Win a $2,500 Winter Shopping Spree" button found on the home page and enter the requested information on the electronic form.
All entries become the property of Carlingwood Shopping Centre and will not be acknowledged or returned. Carlingwood Shopping Centre will not engage in correspondence regarding the "WIN A $2,500 WINTER SHOPPING SPREE" CONTEST with any person other than the selected winner.
WHO CAN ENTER: THIS "WIN A $2,500 WINTER SHOPPING SPREE". CONTEST is only open to individuals who reside in Canada and are at least eighteen (18) years of age as of the beginning of the Contest Period. QUEBEC RESIDENTS: All entrants acknowledge this is a contest originating in Ontario but some entrants will reside in Quebec. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
Double entries of PIN numbers, i.e. entering the same PIN number more than once (more than 1x) during the contest period, will result in second and subsequent entries of that same number being disqualified.
Contestants who enter the Special Code are permitted to enter the code one (1) time per day of the contest period per household. These entries must be made on separate calendar days, any duplicate entries from the same address made on the same day will be disqualified.
Contest is not open to people employed during the contest period who are: owners, management, directors, officers, 3rd party contracted employees or employees of Merchants who have a store at Carlingwood Shopping Centre, Corporate Printers, 20 Vic Management, NewCap Broadcasting, Fenix Solutions or members of those employees' respective immediate families, or anyone with whom any of those employees are domiciled.
Conditions: Awarding of prizes is subject to all standard conditions, restrictions, requirements and regulations of the prize suppliers applicable at the time of delivery and use. Prizes are not transferable and will be awarded to the confirmed winner only - in the case of a minor (person under the age of 18 years) being declared a winner the prize will be awarded to the child's parent or legal guardian. Prize is not convertible to cash or exchange and must be accepted as awarded.
The odds of being chosen winner in the random draw depend upon the total number of eligible entries received during the contest period. Fifty thousand (50 000) PIN cards are printed and one (1) PIN number entry will be chosen a winner by random drawing of numbers.
Winner must: (a) submit valid proof of identity, age and residence; (b) correctly answer, unaided by any other person, the skill-testing question on the electronic ballot; (c) comply with these Rules; and (d) provide the PIN card with the qualifying number.
If the selected winning entrant does not timely comply with the requirements or otherwise fails to comply with these Rules, then in Carlingwood Shopping Centre's discretion, the prize may be forfeited without any liability to the selected entrant or any other person, and another entrant may be selected by random draw in accordance with these Rules.
CONSENT TO PERSONAL INFORMATION COLLECTION, USE AND DISCLOSURE: By entering the Contest, entrants consent to Carlingwood Shopping Centre's collection, use and disclosure of the entrant's personal information provided in contest entries for the administration of this "WIN A $2,500 WINTER SHOPPING SPREE" CONTEST and in aggregated form in order to create reports regarding entrant demographics, reports which Carlingwood Shopping Centre may in its discretion use and disclose to others. Carlingwood Shopping Centre will not otherwise sell or disclose entrants' personal information.
Carlingwood Shopping Centre and each of their respective affiliated and associated persons and entities, are not responsible or liable, jointly or severally, for any of the following:
erroneous, damaged, destroyed, lost, late, incomplete, illegible, incorrectly addressed or misdirected entries, regardless of the cause;
failure for any reason whatsoever of selected entrants to receive prize notification telephone calls or e-mails;
changes in entrants' telephone numbers or e-mail addresses after entry forms are submitted; computer, online, telephone, communication, or technical malfunctions or errors that may occur, regardless of the cause;
or damage or loss, including any loss of use, loss of production, loss of profits (anticipated or otherwise), loss of markets, economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort or under any other theory of law or equity, arising from, connected with, or relating to this "WIN A $2,500 WINTER SHOPPING SPREE" COONTEST, or the contest prize, or the use of the Carlingwood.com website, and regardless of the cause or any negligence by any of Carlingwood Shopping Centre, the prize providers, or any person or entity for whom any of them are responsible, and notwithstanding that Carlingwood Shopping Centre, the prize providers, or any person or entity for whom any of them are responsible, may have been advised of the possibility of such loss or damage being incurred.
If for any reason Carlingwood Shopping Centre determines, in its discretion, that this "WIN A $2,500 WINTER SHOPPING SPREE" CONTEST is not capable of being conducted as intended by Carlingwood Shopping Centre, including due to computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause that corrupts or interferes with the administration, security, fairness, integrity or proper conduct of this "WIN A $2,500 WINTER SHOPPING SPREE" CONTEST may in its discretion disqualify any entrant responsible for such misconduct and withdraw, cancel, terminate, modify, or suspend all or any part of the Contest by publishing a notice on the Website.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR INTERFERE WITH THE LEGITIMATE OPERATION OF this RANDOM DRAW CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND CARLINGWOOD SHOPPING CENTRE RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER RELIEF FROM ALL RESPONSIBLE PERSONS TO THE FULLEST EXTENT PERMITTED BY LAW.
Decisions of the contest organizers regarding any and all aspects of this CONTEST are final and binding on all entrants.
This CONTEST is subject to all applicable federal, provincial and local laws, and is void where prohibited by law. If any provision of these Rules is found by any court of competent jurisdiction to be unenforceable, all other provisions will remain in full force and effect.
Participation in the Contest constitutes acceptance and agreement to these Rules.
Carlingwood Shopping Centre may, in its discretion, change, supplement or amend these Rules as they relate to future Contests from time to time, for any reason, and without any prior notice or liability to you or any other person. Each time you enter, you should check these Rules and review any changes since the last version.
